Terms of Service

Welcome to FootyGazette. These Terms of Service (“Terms”) govern your access to and use of footygazette.com (the “Site”), our editorial content, our newsletter, and our paid streaming service at footygazette.com/watch/ (collectively, the “Services”). Please read them carefully — by using the Site you agree to be bound by them.

1. Acceptance of these Terms

By accessing or using the Site, by subscribing to our newsletter, or by purchasing a subscription to /watch/, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you do not agree, you must stop using the Services.

2. Eligibility

You must be at least 13 years old to use FootyGazette. To purchase a /watch/ subscription, you must additionally be of legal age to enter into a binding contract in your country of residence. We may refuse, suspend, or cancel access if we reasonably believe an eligibility requirement is not met.

3. Editorial content

All editorial content on FootyGazette — articles, photography, illustrations, headlines, captions, summaries, data visualisations, and site design — is owned by FootyGazette or licensed to us, and is protected by copyright, trade-mark, and other intellectual property laws.

You are welcome to:

  • Read, link to, and share our articles on social media.
  • Quote short excerpts (typically up to 75 words) in your own writing, with a clear credit to FootyGazette and a link back.
  • Embed our official social posts through native embed tools.

You may not, without prior written permission:

  • Republish full articles or large portions of articles.
  • Mirror, cache (beyond ordinary browser caching), or scrape the Site at scale.
  • Translate articles in their entirety for redistribution.
  • Remove or alter author bylines, dates, or copyright notices.
  • Use our content, logos, or branding to suggest endorsement or affiliation.

4. User-generated content

FootyGazette does not currently offer reader comments, public profiles, forums, or other user-generated content surfaces. If we add such features in future, baseline terms (you retain ownership, you grant us a worldwide royalty-free licence to host/moderate, no unlawful/defamatory/infringing content) will apply.

5. Subscriptions to /watch/

5.1 Plans and pricing

We currently offer four subscription tiers. All prices are in US dollars (USD) and are displayed on the /watch/ page. Where local currency conversion is performed at checkout, the converted price shown by Stripe is what you will be charged.

Prices and tier inclusions may change. We will not change the price of an existing prepaid term mid-cycle; any change applies only from the next renewal, and we will notify you at least 30 days before it takes effect.

5.2 Payment

All payments are processed by Stripe via secure Stripe Payment Links. FootyGazette does not see or store your card number.

5.3 Auto-renewal (monthly plan)

If you select the monthly plan, your subscription will renew automatically at the end of each billing month at the then-current price. We will email a renewal reminder before each charge where required by law (California ARL, Quebec CPA). You can cancel auto-renewal at any time before the next billing date.

Longer-term plans (3-month, 6-month, 12-month) are sold as fixed-term subscriptions that do not auto-renew unless explicitly indicated at checkout.

5.4 Refund policy

FootyGazette offers a 14-day money-back guarantee with the following condition: if you signed up to /watch/ to follow a particular fixture or competition that you reasonably believed would be available in your region, and that fixture or competition is in fact not available to you for licensing or technical reasons, we will refund your subscription in full within 14 days, on request.

Outside of that, refunds are at our discretion. Refunds are processed back to the original payment method via Stripe within 5-10 business days.

Nothing here limits your statutory rights as a consumer (UK CCRs 2013, EU Consumer Rights Directive 2011/83/EU, Quebec Consumer Protection Act P-40.1, Australian Consumer Law).

5.5 Cancellation

You can cancel with one click from your customer account portal, linked from every Stripe receipt and from the /watch/ “Manage subscription” link. If you have any trouble cancelling, email [email protected] and we will action the cancellation manually within one business day. Cancellation takes effect at the end of your current billing period.

5.6 Regional availability and blackouts

Streaming rights to football fixtures are complex and vary by country, competition, and broadcaster. Where a competition becomes unavailable in your region during your subscription term, we will offer a reasonable remedy (pro-rated refund, account credit, or alternative content) at your choice.

6. Acceptable use

When you use FootyGazette you agree not to:

  • Redistribute, retransmit, restream, record, or otherwise pirate any streaming content from /watch/.
  • Share subscription credentials with people outside your household.
  • Scrape, crawl, or harvest content for commercial purposes including AI/ML training.
  • Use bots or automated tools that impose unreasonable load.
  • Attempt to bypass paywalls, geo-restrictions, DRM, or other technical protection measures.
  • Interfere with the security or integrity of the Site or upload malicious code.
  • Use the Services for any unlawful, harmful, fraudulent, or deceptive purpose.

Breach may result in immediate suspension or termination, without refund, and may be reported to law enforcement.

7. Third-party services

The Services rely on third parties: Stripe (payments), Cloudflare (CDN/security), Google (Tag Manager + Analytics). Your use of these is also governed by their own terms and privacy policies.

8. Intellectual property

“FootyGazette”, the FootyGazette logo, and the visual identity of the Site are trade marks of FootyGazette. Other marks, club names, competition names, and player names referenced on the Site are the property of their respective owners and are used for editorial identification only. Their use does not imply endorsement.

9. Disclaimers

FootyGazette publishes journalism. While we make reasonable efforts to be accurate, we make no warranties about the completeness, reliability, accuracy, or timeliness of any specific article or data point.

  • Nothing on FootyGazette constitutes betting, gambling, financial, investment, or tax advice.
  • Transfer rumours are reported in good faith based on sources of varying reliability; they are not guaranteed.
  • Fixture times, scores, and statistics are sourced from third parties and may contain errors or delays.
  • The Services are provided “as is” to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, FootyGazette and its contributors shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Where liability cannot be excluded but can be limited, our total aggregate liability to you for any claim shall not exceed the greater of (a) the amount you paid to FootyGazette in the 12 months preceding the event, or (b) USD $100.

Nothing excludes or limits liability for death or personal injury caused by negligence, fraud, gross negligence or intentional fault under Quebec civil law (Civil Code of Quebec art. 1474), or any other liability that cannot be excluded by law. Consumer statutory rights are not affected.

11. Indemnity

You agree to indemnify FootyGazette from any claims arising from your breach of these Terms, misuse of the Services, violation of any law or third-party rights, or content you upload. This does not apply to the extent loss arises from FootyGazette’s own breach, negligence, or wilful misconduct.

12. Termination

You may stop using the Services at any time and cancel your subscription per Section 5.5. We may suspend or terminate your access, with or without notice, if we reasonably believe you have breached these Terms. Where we terminate without cause, we will refund any prepaid amount covering the period after termination.

13. Governing law

These Terms are governed by the laws of the Province of Quebec, Canada, and the laws of Canada applicable in Quebec. The owner of FootyGazette is domiciled in Montreal, Quebec.

If you are a consumer resident in the United Kingdom, European Union, or another jurisdiction whose consumer protection law grants you mandatory rights or a mandatory forum, this choice of law does not deprive you of the protection of those mandatory rules.

14. Dispute resolution

For disputes, first contact [email protected]. We commit to good-faith informal resolution for at least 30 days before either side initiates formal proceedings.

If informal resolution fails, disputes will be submitted to the competent courts of the District of Montreal, Province of Quebec, subject to any mandatory consumer forum rights as described in Section 13.

EU consumers can also access the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Changes to these Terms

We may update these Terms from time to time. For material changes (pricing structure, refund policy, governing law, limitation of liability), we will notify active subscribers and newsletter subscribers by email at least 30 days before they take effect.

16. Miscellaneous

  • Entire agreement — these Terms and the Privacy Policy constitute the entire agreement.
  • Severability — if any provision is unenforceable, remaining provisions stay in force.
  • No waiver — failure to enforce a right is not a waiver of that right.
  • Assignment — you may not assign your rights. We may assign ours in a corporate transaction.
  • Force majeure — we are not liable for delays caused by events beyond our reasonable control.
  • Language — the English version of these Terms prevails. Quebec consumers expressly request that this contract be drawn up in English. Les parties ont expressément demandé que ce contrat et tous les documents connexes soient rédigés en anglais.
